Scenic Rivers Law: Regulated versus Non-regulated 1000-foot Corridor

ORC Section 1547.82 requires the review and approval of publicly-funded projects within a 1,000-foot corridor of a designated Wild, Scenic or Recreational River area outside of municipal corporation limits. Examples of these types of projects (roads, bike trails, sewerlines) are shown on the left side of the above graphic.

 

Private land is not subject to any review or approval under the Scenic Rivers law. ORC Section 1547.81 provides for the protection of all private land uses such as home building, logging, grazing, agriculture, etc. Examples are shown on the right side of the above graphic.

Meeting Transcript [PDF; 6.1 Meg] - March 22 meeting regarding the designation of the Vermilion river as a State Scenic River Conducted at Mill Hollow Metro Park. The primary purpose of this meeting was to explain the Ohio Scenic Rivers Program and the designation process and to answer questions specific to the Vermilion River area. In addition, it was an opportunity for the public to comment on the proposed designation either in writing or orally. Because ODNR staff was aware that a significant number of comments was likely, a court reporter was employed to record the comment period of the meeting. The first portion of the meeting (approximately one hour) was dedicated to presenting information about the Scenic Rivers Program, the Vermilion Study, and answering questions from the audience. Because of the informational nature of the first hour of the meeting, it was not recorded by the court reporter. The second part of the meeting was specifically intended to gather public comment. In order to be sure that the comments were captured accurately, an official transcript was recorded by the court reporter. This is that transcript.
